In a wrongful death claim where the person who died has no spouse or children, a personal representative (PR) must be appointed. In most cases the parents act as the PR and are able to receive whatever comes from the claim. If the individual was married, the spouse is then entitled to pursue the claim. This is still true even if they are married and have children.
